KuchBee Terms of Use

1. About KuchBee

KuchBee (“KuchBee”, “we”, “our”, “us”) operates as a technology-enabled services marketplace that connects individuals and businesses seeking services (“Clients”) with independent service providers (“Service Providers”).

KuchBee is not the direct provider of the services listed on the Platform. Services are performed by independent Service Providers. However, KuchBee may implement certain verification, quality-control, or trust-enhancement measures as described in these Terms.

2. Eligibility

To use the Platform, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into binding agreements
• Comply with all applicable local, provincial, and federal laws of Pakistan

We reserve the right to suspend or terminate accounts that violate eligibility requirements.

3. Nature of the Platform and Oversight

3.1 Independent Contractors

Service Providers operate as independent contractors. Nothing in these Terms creates any partnership, joint venture, agency, franchise, or employment relationship between KuchBee and any Service Provider.

3.2 Platform Oversight and Vetting

KuchBee may, at its discretion:

• Conduct identity verification checks
• Review documentation submitted by Service Providers
• Monitor ratings and user feedback
• Suspend or remove Service Providers for policy violations
• Designate certain Service Providers as “Trusted” or similarly labeled categories

Such measures are intended to enhance trust and platform integrity. However, these measures do not constitute supervision, control, or direct management of service performance, nor do they create liability beyond what is expressly stated in these Terms.

KuchBee does not guarantee the skill, licensing status, insurance coverage, or suitability of any Service Provider unless explicitly stated in writing.

4. User Responsibilities

4.1 Lawful Use

Users agree not to:

• Post or request illegal services
• Engage in activities that violate Pakistani law
• Post fraudulent, misleading, or deceptive content
• Use the Platform for scams, financial fraud, money laundering, or unlawful transactions
• Request services involving controlled substances, illegal weapons, explosives, human trafficking, prostitution, or other criminal activities
• Post jobs requiring regulated professional services without ensuring proper licensing requirements are met

KuchBee reserves the right to remove content and suspend accounts involved in suspected unlawful activity and may report such activity to relevant authorities.

4.2 Compliance Obligations of Service Providers

Service Providers are solely responsible for:

• Obtaining necessary licenses and permits
• Maintaining any required professional certifications
• Paying applicable taxes
• Complying with labor, safety, and consumer protection laws
• Maintaining appropriate insurance where applicable

KuchBee does not independently guarantee regulatory compliance of Service Providers.

5. Shared Responsibility and Safety

KuchBee promotes responsible use of the Platform. Users acknowledge that:

• Clients are responsible for exercising reasonable caution when inviting Service Providers onto their premises.
• Clients should secure valuables and sensitive items prior to service appointments.
• Clients should verify job scope, materials, and safety conditions before work begins.
• Service Providers must perform services with reasonable care and skill.

KuchBee shall not be solely responsible for losses resulting from a Client’s failure to exercise reasonable vigilance or safety precautions.

In cases involving theft, property damage, or misconduct, Users must first notify local law enforcement where appropriate and cooperate with any investigation.

6. Payments and Platform Fees

KuchBee may facilitate payments through third-party payment providers. We do not store full banking or card details.

Platform fees, commissions, or service charges may apply and will be disclosed within the app or website.

KuchBee is not responsible for:

• Payment disputes between Users
• Incorrect payment details provided by Users
• Delays caused by financial institutions

7. KuchBee Limited Service Guarantee (Trusted Providers Only)

7.1 Eligibility

For certain Service Providers designated by KuchBee as “Trusted” (or similar designation), KuchBee may offer a limited service guarantee subject to the conditions below.

7.2 Scope of Guarantee

If, after review and verification by KuchBee, it is determined that a Trusted Service Provider directly caused verified property damage during performance of a booked service, KuchBee may, at its sole discretion:

• Reimburse the service charges paid for that job; and/or
• Provide compensation up to a maximum of PKR 20,000.

The total maximum compensation per job shall not exceed PKR 20,000.

7.3 Conditions and Limitations

The Limited Service Guarantee:

• Applies only to services booked and paid for through the Platform
• Requires submission of a complaint within [X] days of service completion
• Requires reasonable documentation and evidence
• Is subject to internal review and verification by KuchBee
• Does not cover consequential, indirect, or speculative losses
• Does not cover pre-existing damage or normal wear and tear
• Does not apply to services performed outside the Platform

KuchBee’s decision following review shall be final with respect to the guarantee program.

This guarantee is a voluntary goodwill policy and does not create insurance coverage or expand liability beyond what is expressly stated herein.

8. Ratings and Reviews

Users may leave ratings and reviews that must be truthful and based on actual experiences.

KuchBee may remove reviews that are defamatory, abusive, fraudulent, or otherwise violate these Terms.

9. Disclaimer of Warranties

Except as expressly provided in Section 7 (Limited Service Guarantee), the Platform is provided on an “as is” and “as available” basis.

KuchBee disclaims all warranties, express or implied, including:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy or reliability of listings
• Continuous or uninterrupted availability

We do not guarantee that services will meet expectations or that Service Providers will achieve specific outcomes.

10. Limitation of Liability

To the maximum extent permitted by law, and except for obligations expressly stated under Section 7, KuchBee shall not be liable for:

• Personal injury or death arising from services
• Property damage beyond the Limited Service Guarantee
• Loss of profits, revenue, data, or business opportunities
• Indirect, incidental, special, punitive, or consequential damages
• Criminal acts committed by Users
• Disputes between Clients and Service Providers

KuchBee’s total aggregate liability for any claim shall not exceed:

(a) The total service fees paid to KuchBee in the three (3) months preceding the event giving rise to the claim; or

(b) PKR 20,000,

whichever is lower, unless otherwise required by applicable law.

11. Indemnification

You agree to indemnify and hold harmless KuchBee, its directors, officers, employees, and affiliates from any claims, damages, liabilities, losses, and expenses (including legal fees) arising from:

• Your use of the Platform
• Your violation of these Terms
• Your violation of any law
• Services performed or received through the Platform

12. Prohibited Conduct

Users may not:

• Circumvent platform safeguards
• Transact outside the Platform to avoid fees
• Upload malicious code
• Attempt unauthorized system access
• Harass, threaten, or abuse other users

Accounts may be suspended or terminated without prior notice for violations.

13. Suspension and Termination

KuchBee may suspend or terminate accounts for violations, suspected unlawful activity, or risk to platform integrity.

Users may delete their accounts subject to outstanding obligations.

14. Dispute Resolution

KuchBee may, at its discretion, facilitate communication between Users but is not obligated to resolve disputes.

Any legal dispute involving KuchBee shall be subject to the exclusive jurisdiction of the courts of Pakistan.

15. Intellectual Property

All content, trademarks, logos, software, and design elements of the Platform are the property of KuchBee or its licensors and may not be used without written permission.

16. Force Majeure

KuchBee shall not be liable for delays or failures caused by events beyond reasonable control, including natural disasters, government actions, internet outages, or technical failures.

17. Amendments

We may update these Terms at any time. Continued use of the Platform after updates constitutes acceptance of the revised Terms.
